Everything started when a Digg user posted a string of hexadecimal code. Those unassuming 32 characters can be used with certain software to allow the playback of HD DVD content on Linux systems, which are otherwise unsupported by the movie industry.

The original story received thousands of Diggs from site users; then, the story vanished. People screamed 'censorship' and began posting new stories containing the code. Those too were short-lived on Digg, but very heavily noticed.

As the stories were removed, some users were banned from Digg for posting the code. Manuel Amador, who runs the Rudd-O blog that started the whole kerfuffle by being linked in the original Digg post, found himself banned when Digg admins received a cease and desist notice to take down the code.

Digg co-founder Jay Adelson blogged about the HD DVD takedown request:

We’ve been notified by the owners of this intellectual property that they believe the posting of the encryption key infringes their intellectual property rights. In order to respect these rights and to comply with the law, we have removed postings of the key that have been brought to our attention. Whether you agree or disagree with the policies of the intellectual property holders and consortiums, in order for Digg to survive, it must abide by the law.

Adelson didn't mention something about HD DVD. As noted by Texyt, some episodes of the DiggNation video podcasts have been sponsored by HD DVD. Digg isn't hiding these sponsorships, but they weren't actively mentioned in context with the other HD DVD activity yesterday either.

However, the issue with the code being online in the first place goes all the way back to February of this year. The source code first appeared on the Doom9 forums, and then made it to a story on a Wired blog.

The final word on the HD DVD encryption key on Digg comes from its most well-known Digger, co-founder Kevin Rose:

But now, after seeing hundreds of stories and reading thousands of comments, you’ve made it clear. You’d rather see Digg go down fighting than bow down to a bigger company. We hear you, and effective immediately we won’t delete stories or comments containing the code and will deal with whatever the consequences might be. If we lose, then what the hell, at least we died trying.

As of press time, Digg was up and running normally.

Mom and Pop Websites? Is Your Brand Big Enough?

When I was on my multi-month critical review of Google a few months back, I frequently highlighted how the perception of spam or quality was often associated with the brand (or lack of brand) behind the content. Stuntdubl wrote a post about brand size reviewing engineer double talk and how brand perception may control the sustainability of your site.

Many people and many sites disappear. For how long just depends on who was behind the infraction and how real their site looks and feels.

About a month ago I asked a friend of mine if he knew that one of his sites got banned from Google. He said no. Then he went and looked at it and asked "why the f*ck did they do that?" His site that was penalized was exceptionally similar to his sites that still rank, with one big exception. It used a default Wordpress theme. Thus it looked like it was probably spam to a search engineer or under-waged remote worker judging a bunch of sites in a rush.

As soon as human editing becomes a big piece of search, humans start thin slicing and start making errors. Once you are gone will anyone notice? Can you escalate the issue to a high enough priority to get your "glitch" fixed?

If you have any top ranking income earning site that exhibits the following traits, look for your income to drop sharply sometime in 2008.

Some cops enjoy handing out speeding tickets. Thin slice your site as though you are a search engineer who enjoys killing spam, but has a quota to kill 1,000 sites a day. Does your site pass the sniff test? Are there areas that could use some improvement?

The democratic nature of the web is a unique concept, but Google no longer uses that line in their marketing brochures. Sometimes the web needs defused.

If you have something that makes money, you need to make it look like it is worthy of its position and earnings. Or else Google will exert as much editorial influence and quality scores as they can to take $$$$$ from you, all in the name of what's good for the customer and helping out "mom and pop webmaster".

After all, when Google Local, YouTube, Google Knol, Google Shopping, and Google Checkout are fully integrated next to AdWords, mom and pop webmaster won't even need to own a website. They can do everything they need on Google.com. How benevolent.

Groups Urge Senate Not To Turn The Justice Department Into Hollywood's Private Police Force

As we noted earlier this summer, Senator Patrick Leahy had introduced a companion bill to the House's dreadful Pro-IP bill, except that Leahy's bill went further. Beyond just adding a "Copyright Czar" position to the White House, it would authorize the Justice Department to start prosecuting civil copyright infringement lawsuits. In other words, it would have the government act as the private police for of the entertainment industry. This is scary stuff. Beyond already handing out unnecessary gov't granted monopolies, the gov't would now be using taxpayer money to settle business disputes from an industry that was only in trouble because it stubbornly refused to update its business model.

It's difficult to see why taxpayers should be paying FBI agents to protect one industry's obsolete business model.

A bunch of special interest groups made that argument to Senators this week, noting that it was a pure gift to Hollywood -- pointing out that all of the companies and groups in the industry already have their own enforcement arms, and it made little sense to have the FBI take part in private business disputes. Hopefully, there are still enough Senators who haven't been convinced by the propaganda provided by the entertainment industry on this issue to recognize what's actually at stake here.
