Trade Association Says FDA Exceeded DSHEA In Ephedra Ban

WASHINGTON, D.C. - A trade organization representing the manufacturers and sellers of natural dietary supplements on April 6 filed an amicus curiae brief in which it argues that the Food and Drug Administration exceeded its authority in demanding that ephedra dietary supplements (EDS) satisfy the clinical risk-benefit analysis required for drugs (Nutraceutical Corp., et al. v. NEW YORK - The ephedra multidistrict litigation judge on July 10 issued an order granting remand of Margaret Parks' case to the U.S. District Court for the Northern District of Oklahoma and denying a motion by Herbalife of America Inc. to exclude evidence that its ephedra supplements contained hydrochloride or sulfate salts of ephedrine alkaloids (Margaret Parks v.
